Authorized representative

The machinery directive's requirement for an authorized representative has not only existed since Brexit. Since Brexit, it has got a new meaning for British and EU companies. After the end of the Brexit transition period, this requirement now also applies to British companies in the EU and EU companies in the UK. On the declaration of conformity, the declaration of incorporation and on the nameplate, the British company must now also name an authorized representative within the EU and the EU company has to name an authorized representative in Great Britain. This is considered as a firm requirement by the UK government effective from 01 January  2021 and is independent of any trade agreement between the EU and the UK.

• Ensure that the machine meets the relevant basic health and safety requirements.
• Ensure that the technical documentation is available.
• Provision of the operating instructions.
• Carrying out the corresponding conformity assessment procedure.
• Issuing and signing the EC declaration of conformity.
• Attaching the CE mark.

Representative and Brexit

In addition to the requirements for the authorized representative, there are further conformity-relevant requirements for manufacturers in the UK, the EU and companies from countries outside the EU. There are direct effects through the recognition of the examination by the “Notified Bodies” but also new certificates such as UKCA and UKNI that must be considered in the next few months.
